Panyako Applauds The Court For Upholding KNUN Preliminary

Kenya Union of Nurses Secretary General, Seth Panyako has applauded the court ruling that was made on Wednesday. In a case which had been petitioned by Halima Aden who is the Director of Nurses in Machakos county.


The court upheld the preliminary objection by the Nurses Union.


Halima had submitted a resignation from the Union as she was appointed the Director of Nurses Machakos County had accused the secretary general to be in office illegally against the constitution of the Union. The court ruled that she could not vie for the Position of secretary General because she is a government representative but still a member of the Union.


“The labor Relation act clearly indicates that a director cannot hold an elective post in a trade Union because they are an agent of the government or a representative of the employer,” Said Panyako.


Panyako accused Halima of being led by her personal motives and being used by some individuals and she could not vie for the post of National Secretary General because she is a director. However, she is still allowed to be a member of the Union. He said Halima should be satisfied by the senior position which she has.

The court ruled that Halima was late and the registrar of trade unions had already registered the union officials which meant the election dispute had already been changed now to a decision of the registrar of trade union.


“Once the registrar registers the officials it seizes being an election dispute and becomes now a dispute based on the decisions made by the registrar of trade unions. We were legally elected as per the Union Constitution. If she had proper Counsel she would have been advised better to appeal against the decision of registrar of trade unions as provided under Section 30 the labor and relations Act,” Paused Panyako.
