The Supreme Court has struck out an appeal case that Mike Sonko had filed seeking to stop Anne Kananu from being sworn in as Nairobi County Governor.

The appeal was filed by Former Nairobi Governor Mike Sonko decrying un procedural removal from office.

The ruling by the court now means that Kananu can be sworn in as the Governor of Nairobi.

“The court, we conclude lacks jurisdiction to entertain the application,” reads part of the ruling.

Supreme Court judges noted that with the absence of a judgement of the court of appeal the application by Sonko is premature and does not meet the threshold of the Constitution.

Sonko wanted the Supreme Court to prohibit the swearing-in of Kananu as Nairobi Governor pending hearing and determination of his appeal.

Last month, the appellate court dismissed Sonko’s appeal of the High Court decision okaying his removal from office in December 2020 forcing him to move to the Supreme Court.
