Elachi, Nairobi Service Board on EACC Radar Over Irregular Promotions

A storm is brewing at the Nairobi County Assembly after Ethics and Anti-Corruption Commission (EACC) waded in to investigate the promotion of 28 senior officers between 2017 and 2020.

At the time Beatrice Elachi who is currently the Gender Chief Administrative Secretary, served as Nairobi County Assembly Speaker.

In letter dated September 22 that was seen by Taarifa News and which was directed to the clerk of the assembly, EACC is requesting for several documents to probe the alleged irregular promotion of staff.

The anti-graft agency is also seeking answers from Nairobi City County Assembly Service Board (NCASB) then Chaired by Elachi, over allegations of unlawful expenditure and loss of public funds. 

EACC is now putting the CAS and the board at the centre of the investigations accusing them of undertaking the promotions in total disregard of the law and due process.

Elachi and the board have been accused of discrimination and bias in appointments, promotions carried out without requisite budgetary provisions, irregular supersession of unqualified junior officers to senior positions, irregular recruitments and disregard for schemes of service in terms of qualification and experience.

Among the issues in contention has been the formation of parallel deputy clerk offices.

Just last month the promotion of 28 officers sparked unrest with claims of nepotism forcing the labour relations court to  intervene

In a list of 27 demands by the anti-graft agency City Hall will be required to produce:

  • Nairobi City County Assembly Human Resource Policies and Procedures Manual
  • The approved board’s scheme of service, and organisational structure from 2014
  • The Deloitte and Touche Consultancy report (including the contract for the provision of consultancy services, LSOs, invoices, and payment vouchers for the consultancy services)
  • The minutes of the Board approving the engagement of Deloitte to review the board’s organizational structure and approving the final report of Deloitte as well as a copy of the internal advertisement for the positions which were advertised in June 2020.
  • Personal files for the Deputy Clerk Administration and all Directors of the Nairobi County Assembly Service Board (NCASB),
  • List of principal officers, senior officers, and all officers given direct appointments;
  • Other documents required are approved budget for the 2019/2020 and 2020/2021 financial years
  • Staff payroll for May to December 2020, and the payroll for all staff on contract for May to December 2020 among other documents.

  • The approved board’s scheme of service
  • Organisational structure from 2014
