Relief as Court Bars NCCG from Prosecuting Ex Employees

Milimani law court has put on hold the implementation of the public accounts committee report on liquor board which has revealed that the former officials misappropriated county funds.

The four in court are former County Executive Committee Member for Finance, Budget and Appropriation- Allan igambi, former Chief Officer finance Mohamed Sahal, former County Secretary Jairus Musumba and former liquor board chairperson and accountant Hesbon Agwena and Julius Matekwa respectively and Nyangweso.

In the petition signed by High Court Judge Jairus Ngaah stating that, “I have read the applicant’s application dated 26th June 2023 filed under a certificate of urgency of even date.”

The judge further directed that the substanding motion to be filed and served within 7 days of the date of the ruling.

“The respondent to file and serve their response within 7days of the date of the service of the applicants’ motion,” read part of the ruling.

The suit shall be mentioned on 17th July 2023 for purposes of taking further direction on the matter of its disposal, it’s so ordered,” the judge directed.

The petitioners in the application say the audit report was intentionally delayed therefore contravening the law, they further argued that the Assembly did not accord them a fair hearing.
