MCAs File Habeas Corpus Petition to Locate Missing colleague

DunstanMembers of the County Assemblies from Wajir and Garissa counties have filed a habeas corpus petition seeking the government to produce Wajir’s Della Ward MCA, Yusuf Hussein, in court, whether alive or dead. The application was filed by lawyer Danstan Omari, acting on instructions from the Wajir County Assembly.

Yusuf Hussein was reportedly abducted five days ago near Industrial Area, Nairobi, by armed individuals suspected to be police officers. According to the MCA’s colleagues, the abduction took place just a few meters from the Industrial Area Police Station, raising concerns about the possible involvement of security forces.

Speaking at Milimani Court, Omari said,

“I have the instructions from the County Assembly of Wajir to file an application for the release of Yusuf Hussein, a member of the County Assembly for Della Ward. Following his abduction five days ago, he has not yet been found. We want the judge to compel the investigation agencies to produce him in court.”

Wajir County Speaker Yusuf Abdille expressed dissatisfaction with how the security agencies have handled the case, stating that despite the passage of time, no significant progress has been made to locate the missing MCA.

“We have done all that we can to find this member of the county assembly. The family, friends, and all the electorates are living in fear. Everything in Wajir is at a standstill because we are all here in solidarity, so we can get one of our members,” said Abdille.

The MCA’s disappearance has caused significant anxiety within his community, and the situation has prompted local leaders to demand urgent action from the authorities.

The petition, filed against Acting Inspector General of Police Gilbert Masengi and Director of Criminal Investigations Amin Mohammed, calls for an immediate investigation and for the authorities to produce Hussein before the court.

The judge is yet to issue a ruling on the case.
